Mohabbak Giftery

Welcome to Mohabbak Giftery. By accessing our website, placing an order, or using our services, you agree to these Terms & Conditions. Please read them carefully before purchasing.

1) About Us

Mohabbak Giftery is a gifting brand based in the UAE, providing customized and curated gifting solutions in the UAE and India. Many customers order gifts from India to surprise their loved ones in the UAE, and we also serve UAE residents and nationals.

2) Eligibility

By using our services, you confirm that:

  • You are at least 18 years old, or using the website under a parent/guardian’s supervision.

  • The information you provide is accurate and complete.

3) Products & Customization

Most of our products are customized or personalized, including (but not limited to):

  • Photo frames & printed gifts

  • Gift hampers & packages

  • Chocolates & customized combos

  • Cakes

  • Flowers

📌 Note:
Customization may include name printing, photo printing, text messages, color themes, packaging style, or custom gift combinations.

✅ We try our best to match designs shown on the website, but slight variations may occur due to:

  • availability of materials

  • seasonal flower changes

  • hand-made packaging

  • lighting differences in images

4) Orders & Confirmation

  • Orders can be placed through our website (and any official channel we provide).

  • After payment/order confirmation, you may receive updates through WhatsApp/SMS/email (where applicable).

  • Mohabbak Giftery reserves the right to accept, reject, or cancel any order due to product availability, incorrect address, or suspected fraud.

5) Pricing & Charges

  • Product prices are shown on the website and may change without prior notice.

  • Delivery charges (if applicable) will be displayed during checkout.

  • Some special dates (Valentine’s Day, Eid, New Year, etc.) may have rush/priority delivery charges.

6) Payments

We accept multiple payment options including:

  • Stripe payments (Card / International payments)

  • UPI (in selected cases)

  • Cash on Delivery (COD) (available only for selected items/locations)

  • Other payment methods (if enabled on website)

📌 COD Rules:

  • COD availability depends on delivery area and product type.

  • We may contact you to confirm the order before processing COD.

  • COD orders may require partial advance payment in some cases.

7) Same-Day / Express Deliveries

If you choose same-day / urgent / express delivery, please note:

  • Delivery timing is based on slot availability and location.

  • Once an express order is confirmed or dispatched, cancellation may not be possible.

8) Delivery Policy (UAE & India)

We deliver through:

  • our own delivery partners (selected locations)

  • courier/shipping partners for shipped items

Delivery timelines depend on:

  • delivery location

  • customization time

  • courier operations

  • weather, traffic, public holidays, or peak-day rush

✅ We try our best to deliver on time.
❗ However, delays caused by third-party courier or conditions beyond our control may happen.

9) Customer Responsibilities

Customers must provide correct:

  • recipient name

  • delivery address

  • phone number (reachable at delivery time)

  • delivery date & time slot (if applicable)

  • customization details (photo/text/spelling)

📌 If the address/phone number is incorrect or unreachable, delivery may fail and extra delivery charges may apply.

10) Changes to Orders

Because items are customized, order changes are allowed only before preparation starts.

Once the order is under processing/printing/packing:

  • changes may not be possible

  • additional charges may apply

11) Cancellations

✅ Orders can be cancelled only before dispatch/preparation.

❌ Cancellation is not allowed for:

  • customized/personalized items once processing begins

  • same-day / urgent delivery orders once confirmed

  • shipped/courier orders after dispatch

12) Returns, Replacements & Refunds

Since many products are customized and perishable (cakes/flowers), returns are limited.

Refund/Replacement is accepted only if:

✅ product is damaged
✅ wrong item delivered
✅ major issue in customization from our side

📌 You must inform us within 24 hours of delivery with proof.

Required Proof

To request support, customer must share:

  • order number

  • clear product photos

  • packaging photos

  • unboxing video (highly recommended)

Refund Time

If approved, refunds will be processed within 7 business days to the original payment method.

13) Perishable Items (Cakes, Flowers, etc.)

For cakes, flowers and perishable items:

  • slight design or color variations may occur depending on availability

  • delivery delays due to recipient unavailability can affect freshness

  • we are not responsible for spoilage caused by late acceptance/refusal by recipient

14) Non-Delivery / Recipient Not Available

If delivery fails because:

  • recipient not answering

  • wrong address

  • location not accessible

  • receiver refused delivery

Then:

  • a re-delivery charge may apply

  • refund is not guaranteed (especially for perishable/custom items)

15) Intellectual Property & Customer Content

If you share photos, names, logos, or message text for customization:

  • you confirm you have the right to use them

  • you allow us to print/use them only for your order fulfillment

We do not claim ownership of your personal photos.

Mohabbak Giftery’s logo, designs, website content, and creative materials cannot be copied without permission.

16) Limitation of Liability

Mohabbak Giftery will not be responsible for:

  • delays caused by courier or external conditions

  • minor product variations

  • incorrect details provided by the customer

  • indirect losses (emotional loss, missed surprise moment, etc.)

Our maximum liability, if any, will be limited to the order value paid by the customer.

17) Fraud & Misuse

We reserve the right to cancel or block orders if we suspect:

  • fraud / chargeback abuse

  • fake COD orders

  • misuse of promotions/coupons

  • repeated false complaints

18) Governing Law

These Terms are governed by applicable laws in the United Arab Emirates (UAE).
If required, disputes will be subject to the relevant jurisdiction as per UAE law.
